    DCMA CPSR News and Trends
    This session will be paneled by two of the senior leaders within the DCMA Contractor Purchasing System Review (CPSR) Group – Mr. John Foley and Mr. Randy Shelby. With DCMA CPSRs pivoting to a virtual format during COVID, the first update to the DCMA CPSR Guidebook in several years being released the same time period and the Group’s continued vigilance in reviewing contactors’ purchasing systems at a regular cadence, Mr. Foley and Mr. Shelby will speak to Capital Edge Managing Partner, Mr. Chase Kunk, about the latest and greatest news and trends coming out of the DCMA CPSR:
    • Recent DCMA CPSR Group metrics – headcount, attrition, completed reviews by fiscal year, etc.
    • New steps and processes implemented by the DCMA CPSR Group – Active Contracts Listing, Level II Corrective Action Request, etc.

    DCAA Audit News and Trends
    This session will be paneled by Robert Eason, DCAA Division Chief and Anthony Kim, Capital Edge Consulting.  With DCAA outsourcing certain incurred cost audits, more time and resources are available for other audits such as Truth in Negotiations, Forward Pricing Proposals, and Business Systems.  In light of DCAA report to congress being published in March, Mr. Eason will share some insightful news and trends related to DCAA audits.
    • DCAA upcoming initiatives and more on the current-state of DCAA audits
    • Anticipated updates or changes to the Audit Programs
    • Most Common Deficiencies stemming from recent Accounting, Estimating, and MMAS Audits
    • Information on potentially adopting DCMA’s Level II Corrective Action Request for business system audits

     
    Reducing Defective Pricing Risk Through Effective Estimating System Controls
    An analysis of DCAA’s annual Report to Congress and the Department of Justice's annual False Claims Act Settlements and Judgments reports illustrates the government’s continued focus on defective pricing matters. Allegations and findings of defective pricing (i.e., failure to provide current, accurate, and complete cost or pricing data, when required) can have a significant negative impact on government contractors, including a unilateral contract price reduction, civil and criminal penalties, a significant deficiency in the estimating and/or accounting system, and/or negatively impacting eligibility to receive certain contract awards. In this session, we will analyze common causes and indicators of defective pricing, including common red flags and risk factors. 

    As the detailed agenda suggests, this session will focus on how establishing an effective estimating system that complies with the DFARS 252.215-7002, Cost Estimating System Requirements clause can help mitigate the risks of defective pricing. Through robust internal controls, including implementing rigorous policies & procedures, developing a consistent and supportable approach to estimating, and establishing thorough review procedures throughout the estimating process, contractors can significantly reduce the likelihood of a defective pricing allegation. This course will focus on how contractors can apply leading practices to enhance estimating internal controls to minimize the risk of a defective pricing finding. 

    Lastly, we will explore how recent regulatory and legislative developments may impact future defective pricing audits and the types of cost or pricing data that contractors may be required to furnish in order to meet their TINA obligation to disclose current, accurate, and complete cost or pricing data.
