Day 1 Session 3 -- Bid Protests: 2024 Developments, Trends, and Lessons for the Legal Department and Management

A staple in the Year in Review program, Bid Protests give insights into what lies ahead for contractors when ambiguous contract language and mis-interpretations can lead to confusion and cost both the buyers and sellers money.   Annually, the GAO releases their report to Congress on protests heard by the GAO.  But beyond GAO, the session will discuss other major protests from the COFC and other jurisdictions that have an impact on contractors.

  • Ryan Berry
    Managing Partner, Ward & Berry
    Ryan Berry co-founded Ward & Berry with Dan Ward in 2017. Although Ryan is active in all of the firm’s practice areas, his current client work comprises investigations, corporate compliance, and general counsel representation of government contractors.

    Before co-founding Ward & Berry, Ryan was an equity partner in one of the largest global law firms. He has successfully handled significant commercial litigation matters through trial for national security, technology, and sports and entertainment clients.

    Ryan is experienced in handling international disputes and investigations for government contractors and multi-national corporations. His work in this area has been particularly focused on the False Claims Act (FCA) and the Foreign Corrupt Practices Act (FCPA). Ryan has skillfully guided clients through investigations brought by the Inspector General (IG) of federal agencies, Congressional investigations, suspensions and proposed debarments.

  • Moshe Broder
    Partner, Jenner & Block
    Moshe Broder assists government contractors in navigating diverse issues across the government contracts and grants landscape. Moshe prosecutes and defends complex and high-stakes bid protests before the US Government Accountability Office (GAO) and the US Court of Federal Claims (COFC). He has litigated more than 100 protests and has repeatedly obtained meaningful relief for clients in strategically important procurements.

    In addition to bid protests, Moshe also counsels clients on a broad range of legal issues and represents government contractors in contract claims and disputes. Moshe conducts internal investigations and represents government contractors in all states of civil litigation. He has a special interest in issues involving national security and cybersecurity, and advises government contractors in disputes and bid protests involving classified programs.

    Moshe maintains an active pro bono practice.
