Day 1 Session 6 -- The Contract Disputes Act: Jurisdictional Issues, Performance Problems, and Termination Developments

In 2024 we saw several cases impacting the industry in the areas of Statute of Limitations, Claims Submission and the Contract Disputes Act.  Highlights include cases argued in front of the ASBCA on Statute of Limitations; Substance of Claim and Contract Scope.  Other cases discussed are based on Release of Claims involving NASA, GSA and US Coast Guard.  The session will finish up with cases involving Contract Interpretations argued in front of the Civilian Board of Contract Appeals (CBCA).

  • Marques Peterson
    Managing Partner, Pillsbury Firm Washington, DC Office
    Marques Peterson is the managing partner of the firm’s Washington, DC office. His practice focuses on counseling and representing aerospace/defense and civil contractors in both federal procurement and international defense sales.

    Marques has significant experience in bid protests and contract performance disputes before the Government Accountability Office, the Court of Federal Claims, and the Boards of Contract Appeals. He also regularly counsels clients on a wide array of government contract compliance issues, including contracting with the General Services Administration (GSA), pricing issues, and mandatory disclosure requirements.

    Prior to entering private practice, Marques served on active duty in the Air Force Office of General Counsel at the Pentagon, where he counseled senior leaders on numerous acquisition-related matters including services contracting and space acquisitions.

    A government contracts lawyer in Los Angeles, Michael prepares Contract Disputes Act certified claims; resolves contract disputes before the ASBCA, the CBCA, California federal and state courts, and in arbitration; and handles termination disputes at the federal, state and local government levels. He defends lawsuits filed under the Civil False Claims Act. He crafts comprehensive government contracts compliance programs designed to reduce clients' future exposure and legal expenditures. Additionally, Michael is experienced in handling internal investigations into quality assurance and pricing issues.
