This is session 2 of 2 in the Changes and Claims in Government Construction Contracting virtual course.

Based on our popular classroom course, this survey class provides you with the most recent information on legal and regulatory issues in doing government contracting and subcontracting in foreign countries. Its primary focus is to give you an understanding of opportunities and risks in foreign government contracting and performance of U.S. Foreign Military Sales contracts.   

We will focus on opportunities and risks in government contracting in foreign markets and the overall international legal and regulatory environment in foreign contracting. This includes understanding the roles of foreign government customer and regulatory organizations, as well as the World Trade Organization, various Trade Agreements, and relevant US regulations including those governing Foreign Military Sales and Foreign Military Financing contracting, and Direct Commercial Sales contracting.

We will also discuss the very hot topics of sanctions, export controls and anticorruption law and regulations.

  • Bob Vander Lugt
    Partner, Little, Rothwell and Vander Lugt, PLLC
    Bob’s law practice focuses on the application of international trade, government procurement and national security law and regulations. He regularly advises both U.S. and foreign clients on international trade matters including: the application of export controls such as the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR), the sanctions regulations administered by the Office of Foreign Assets Control (OFAC), and U.S. and foreign anti-corruption controls including the U.S. Foreign Corrupt Practices Act (FCPA).

    In the government contracts area, Bob advises and assists clients in the defense, aerospace, technology, software, telecommunications, health care, energy, and manufacturing sectors with claims, bid protests, and counselling. In his national security law practice, Bob leverages experience as a retired naval intelligence officer (with command and combat experience) to assist U.S. and foreign clients with reviews by the Committee on Foreign Investment in the United States (CFIUS), as well as security clearances and compliance with the National Industrial Security Program (NISP), nuclear and naval nuclear technology controls, and the DoD technology release processes.
