This is session 3 of 3 in the Labor Compliance series.

This session focuses on the prevailing wage and apprenticeship requirements reflected in the IRS IRA tax credit. Commercial companies with limited or no experience receiving federal funds (i.e., have never operated as a government contractor) are being faced with strict rules that govern employee pay and benefits. These rules require increased process controls and record retention procedures. This session both outlines the requirements associated with the prevailing wage and apprenticeship programs and also reviews the differences between these requirements and the Davis Bacon and Related Act regulation. 

Learning Objectives: By the end of this session, attendees will be able to:
  • Know the basic requirements associated with prevailing wage and apprenticeship programs
  • Understand the differences between prevailing wage / apprenticeship programs and the Davis Bacon and Related Acts
  • Learn how to establish compliant practices utilizing your Company’s people, processes, and technology 
  • Recognize how to monitor and track ongoing compliance with the requirements, including techniques for monitoring subcontractor compliance

  • Gabrielle M. Irwin
    Senior Associate Consultant, HKA
    Gabrielle M. Irwin is a Senior Associate Consultant in the New York office of HKA Global, Inc. She has been with HKA for almost three years, and she is under HKA’s Government Contracts practice area. Her experience includes variance analysis, cost analysis, research, review of documents, and finalization of documents for expert testimony. She is from Northern California and studied International Business, French, and Studio Art at Georgetown University.

    Gabrielle has supported clients and engagements that focus on cost, compliance, and damages. She has conducted analyses of cost, basis of estimate, and estimate at completion. She has assisted in accounting and financial analyses in multiple contexts, including potential overbillings. Gabrielle is interested in compliance and is currently specializing in compliance cases. She has familiarized herself with prevailing wage laws and FAR, and she has experience applying those regulations to develop cost accounting policies and best practices for monitoring compliance.
  • Rachelle Jackson
    Director, HKA
    Rachelle Jackson has more than 10 years of experience working in government contract compliance, strategy and advisory.

    Rachelle undertakes assessments of client accounting and finance practices, performs mock audits of business systems, implements remedial action plans and internal controls critical to managing compliance and financial risks. She also specializes in assisting contractors in responding to audit requests.

    Rachelle’s career has focused on Federal labor compliance including the Service Contract Act (SCA), Davis Bacon Act (DBA) and the Internal Revenue Service (IRS) Inflation Reduction Act (IRA) prevailing wage and apprenticeship programs. She conducts detailed back pay calculations and implements best-practice controls within business processes.

    Rachelle has in-depth knowledge of the regulations contained within the Office of Management and Budget (OMB) Circulars, Code of Federal Regulations (CFR) 200, Federal Acquisition Regulation (FAR), Defense Federal Acquisition Regulation (DFARS), and the Cost Accounting Standards (CAS). She supports federal government contractors in preparing strategic and compliant proposal price estimates when responding to Federal Requests for Proposals (RFP), reviewing forward pricing rate proposals (FPRP), incurred cost proposals (ICP), and negotiating indirect cost rate agreements (NICRA). She has also assisted with strategic cost accounting restructures, cost accounting non-compliances and changes which includes preparing general dollar magnitude (GDM) or detailed cost impacts (DCI).
    Rachelle has a bachelor’s of business administration in finance and is a member of the Young Professionals Committee for the Colorado’s Judicial Institute.
