This is session 3 of 3 in the Doing Business with the DoD Series.

In this session we will address “Just what happens after you get a DoD contract?” We will start by understanding just how important “past performance” is in getting subsequent contracts. The DoD Supplier Performance Risk System (SPRS) is a critical component of the DoD’s new emphasis on past performance and in scope is enormous. One thing is certain, your new contract will most certainly change over time and you need to understand just what can change and what your entitlements are to a change. Knowing how delays affect your contract as well as how the DoD will oversee your performance. You may or may not be aware the DoD can terminate your contract whenever they desire (which stipulations of course).

Learning Objectives:
These processes and entitlement will be explored. When you fail to perform the DoD can terminate your contract and hold you accountable. Understanding your rights and actions can help alleviate those troubling times.

  • Jeremy Becker Welts
    Government Contracting Instructor
    Jeremy Welts began the practice of law following graduation from William & Mary Law School in 1986. He initially worked as an associate attorney in commercial litigation for a law firm in New England until 1989, when he was hired by NASA Langley Research Center as an Attorney Advisor. At NASA Langley, his work included advising on general law issues (procurement, construction, FOIA, tort, and fraud) serving as counsel to source evaluation boards, source selection officials, negotiating Space Act Agreements, and litigation counsel in procurement- related activities and tort defense.

    Jeremy left NASA in 1995 to join the department of Navy Office of General Counsel as a Senior Trial
    Attorney. While at Navy, he served as a trial attorney with the joint Department of Navy/Department of Justice A-12 Litigation Team.

    Following his time on the A-12 Litigation Team, Jeremy was appointed Senior Assistant General Counsel with the U. S. General Services Administration (GSA), beginning in 1998. He served primarily in the Real property Division, where he analyzed and defended construction and lease-related claims and provided counsel to high-profile ongoing construction projects and Agency Senior Management. During his tenure at GSA, Jeremy served as lead counsel on 51 cases with claims totaling overall $610,683,384. Additionally, he designed and implemented a pilot program to provide risk management support for ongoing major construction projects.

    In 2006, Jeremy joined the nationally-ranked law firm Bradley Arant Boult Cummings, LLP, as a Senior Attorney, where he provided direct consultation, analysis, training in government contracting, and assistance for clients and counsel relating to wide range of government procurement and construction issues. He also provided legal and factual analysis, strategic planning, and legal writing to firm counsel for the presentation and resolution of federal contractor claims before agencies, boards of contract appeals, and federal courts.

    From January 2010 until his retirement in January 2014, Jeremy served as Assistant District Counsel for the Middle East District of the U.S. Army Corps of Engineers. He was responsible for assisting the Corps in successfully awarding and administering construction contracts throughout the Middle East. During his time at the Corps, he was a key player in the solicitation, evaluation, source selection and awarding of a $3.8 billion multiple award task order program serving construction efforts throughout the entire Middle East. While at the Middle East District, he was awarded the Superior Civilian Service Award Medal twice and was recognized as the Attorney of the Year for both 2011 and 2012.

    Throughout his Federal career Jeremy provided training within his various agencies in all aspects of Federal contracting, presenting workshops and training sessions on such subjects as Negotiations; FAR Workshops; Source Selection; Construction Contracting, and Contract Management. In 2011 he joined the faculty of Federal Publications Seminars and has served primarily as an in-house trainer for them in both government and industry. He has presented over 200 training sessions for Federal Publications, including the topics of Negotiations; FAR Overview; FAR Workshops; Source Selection; and Construction Contracting, as well as for other educational companies and as an independent contractor. Typically, Jeremy tailors his training sessions to provide specific content relevant to client business lines, strategies, and goals. Since 2012, he has averaged 350 hours per year in direct classroom presentation time.
