This is Session 8 of the Foundations of the FAR webinar series.

This session of the Foundations of the FAR program will cover Part 22 - Application of Labor Laws to Government Contracting Acquisitions. Franklin Turner of McCarter & English will discuss how these laws work into the contracts including EEO; SCA; human trafficking and basic labor policies.

Part 22 Scope
This part:
  • Prescribes general policies regarding contractor labor relations as they pertain to the acquisition process;
  • Prescribes contracting policy and procedures to implement each pertinent labor law and Executive order; and
  • Prescribes contract clauses with respect to each pertinent labor law and Executive order.

  • Ethan Brown
    Associate, Duane Morris LLP
    Ethan M. Brown focuses his practice on finding practical solutions to challenges facing government contractors. His extensive experience in the government contracts includes counseling clients in diverse industries on compliance, regulatory, and enforcement matters relating to a wide range of federal, state, and local procurement laws and regulations, including the FAR and DFARS.

    His broad litigation background includes experience with bid protests before the Government Accountability Office, the U.S. Court of Federal Claims, and state and local agencies; complex claims before the Boards of Contract Appeals; and other disputes before government agencies and various U.S. District Courts. In his counseling practice, Ethan regularly advises government contractors of all sizes on compliance with government regulations, including requirements concerning cybersecurity, GSA multiple award schedules, the Buy American and Trade Agreements Acts, supply chains, cost accounting, subcontracting, mandatory disclosures, and data rights. Ethan also has experience drafting and negotiating teaming agreements, non-disclosure agreements, subcontracts, and supplier agreements. His additional experience in conducting internal investigations ensures that clients are in full compliance with applicable regulations.

    Ethan has extensive experience with both Small Business Administration (SBA) requirements and in advising parties regarding the acquisition of a government contractor. He routinely assists clients with issues regarding the SBA’s size standards, affiliation, subcontracting requirements, and socioeconomic programs, and he has successfully litigated size and socioeconomic status protests before the SBA’s Office of Hearings and Appeals. He also has significant experience drafting joint venture agreements and corporate governance documents for small-business clients. For acquisitions involving government contractors, Ethan has conducted due diligence, drafted and negotiated key transaction documents, and advised the parties on unique regulatory issues that may arise during or after the transaction.
    EDUCATION
    Ethan is a graduate of Georgetown University Law Center and the University of Tennessee, Knoxville. He frequents lectures and writes on a wide variety of government contracting topics.
