Section 809 Panel Recommendations: What They Mean For Protesters The FY 2016 Defense Authorization Act created an advisory panel tasked with identifying ways to improve the defense acquisition system. In mid-January, the Section 809 Panel released the third and final volume of its report on streamlining and codifying acquisition regulations.

This webinar will provide an overview of the Panel's recommendations as they relate to bid protests. We will explore the relevant recommendations, discussing the impetus for the recommendations as well as the impact the recommendations may have on government contractors.

    Gregory H. Petkoff is a partner in the Government Contracts Practice. He represents large and small businesses and institutions on government contract matters involving defense and civilian agencies. He has recorded more than 200 reported decisions in bid protests and has resolved major claims against the government using ADR processes in both the government and private practice. He also has extensive experience in False Claims Act litigation, investigations by agency inspectors general, mandatory disclosures and related enforcement actions.

    Carla Weiss advises large and small clients on a range of high-stakes government contract issues. She is a well-known bid protest practitioner, with successful matters before the Government Accountability Office, Court of Federal Claims, SBA Office of Hearing and Appeals, and FAA Office of Dispute Resolution for Acquisition. In partnership with clients, she provides strategic legal guidance throughout the acquisition process, and ultimately represents protesters challenging contract decisions—and intervenors defending their awards.

    Carla also has significant experience handling internal investigations for government contractors and representing contractors and subcontractors in claims litigation against the government. In addition, she counsels clients on a variety of federal statutes, regulations and government contract-related compliance matters, including FAR and DFARS interpretation, SBA small business and socioeconomic programs and eligibility, and foreign sourcing requirements. Through multiple secondments, Carla has seen first-hand the pressures and demands facing government contractors, and she brings that in-house perspective when advising clients.

    Prior to joining the firm, Carla served as a law clerk to former United States Senator Arlen Specter at the Senate Judiciary Committee. She also worked at the National Republican Senatorial Committee and interned with the White House Office of Public Liaison.
