Overview
Defective Pricing’s history began in the 1960s when Congress enacted the Truth in Negotiations Act, now renamed Truthful Cost or Pricing Data. Over the past 50 years contractors’ business processes have evolved as a result of DCAA and IG oversight, and case law. Recently DCAA has retooled to increase post award audits designed to detect defective pricing. Because of DCAA’s defective pricing emphasis, contractors may face significant adverse contract price adjustments and audit assertions of inadequate estimating systems. Peril also comes from IG emphasis on assessing defective pricing issues as potential fraud indicators.

This workshop will provide opportunities to discuss issues and answer questions.

Learning Objectives:
To address this environment, the objectives of this two-day workshop are:
  • Obtain an up-to-date summary of the underlying defective pricing statute and significant case law.
  • Understand FAR contract clauses and when they apply.
  • Review DoD, IG and DCAA guidance and audit programs.
  • Use scenarios to discuss best practices for avoiding defective pricing and defending defective pricing allegations.
