The Buy American Act (BAA) promotes the use of American-made supplies by imposing a price preference for "domestic end products" and "construction materials" in federal procurements via FAR Part 25.  The Agreements Act of 1979, is an Act of Congress that governs trade agreements negotiated between the United States and other countries under the Trade Act of 1974. Essentially, it requires that end products from designated countries be treated the same as U.S.-made products for government procurement purposes, and prohibits the acquisition of end products from other, non-designated countries.

Government contracts for the purchase of goods and products commonly require certification that the contractor’s products comply with the Buy American Act (BAA) or Trade Agreements Act (TAA).

This brand new 4-day BAA/TAA Series gives in-depth coverage of the following:

Day 1 - The multiplicity of, and distinctions among, “Buy American” and other domestic preference statutes, regulations, and policies, for example, President Biden’s Executive Order on Ensuring the Future is Made in All of America by All of America’s Workers
  • We'll cover the basics of the BAA, TAA, and implementing regulations
Day 2 - Domestic preference requirements that apply to Department of Defense contractors.  
  • We will examine the differences (or no) between the Buy American Act/Trade Agreements Act rules applicable to civilian and DOD procurements, and examine the specific domestic preference requirements applicable to certain categories of items procured by the DOD. 
Day 3 - Statutes, regulations, and guidance that apply to procurements (typically by state and local transportation agencies and authorities) using grants and other funding from the Department of Transportation agencies.  
  • We will examine the “Buy America” statutes applicable to projects funded by the Federal Transit Administration, the Federal Highway Administration, the Federal Railroad Administration, Amtrak, and the Federal Aviation Administration, and examine the unique challenges that arise in complying with each of these agencies’ requirements.      
Day 4 - Four different areas which affect contractors across a multitude of sectors.  
  • We will cover significant restrictions on the country of origin of products and components, the supply of certain products, the receipt of investments, and the use of employees from China or other countries that may prohibit you from contracting with the United States government.
